Thailand's Practice of Detention of Surrendering Cambodian Soldiers Upholding Human Rights Principles & International Law

In response to media inquiries regarding the detention of surrendering Cambodian soldiers by the Thai Army following the clash in Sisaket Province, Mr. Nikorndej Balankura, Director-General of the Department of Information and Spokesperson of the Ministry of Foreign Affairs, would like to provide the following information as received from the Royal Thai Army:

1. The incident occurred after the Cambodian side employed weapons and fired into Thai territory. As a result of the Thai side’s counter-operations, 18 Cambodian soldiers, with ranks ranging from Lance Corporal to Second Lieutenant, surrendered without any threatening posture or behavior toward the Thai side.

2. The Thai side proceeded to disarm and detain them according to appropriate procedures, strictly adhering to international humanitarian principles. The injured Cambodian soldier was  subsequently sent to receive medical treatment at the hospital.

3. Currently, all Cambodian soldiers remain under detention at a secure location within the 2nd Army Area, where appropriate care has been provided in accordance with international military standards of practice and international humanitarian principles. They will be subject to relevant processes accordingly.

4. Additionally, 2 fatalities were also discovered in the area. The Thai side will proceed to repatriate the remains of the deceased in line with international standards of practice for the dignified treatment of combatants.

5. The Royal Thai Armed Forces reaffirms its commitment to strictly upholding the principles of human rights, international humanitarian law, and Thailand’s obligations under the Geneva Conventions regarding the proper treatment of enemy soldiers and the deceased.
